1.1 These terms and conditions (T&Cs) apply to all contracts concluded via the online platform Treeming.org between us, the Treeming Organisation, and you as the customer (hereinafter referred to as “User”).
1.2 Treeming.org offers online courses that can be used for both personal and commercial purposes.
1.3 These T&Cs apply equally to individual consumers as well as business customers, unless explicitly stated otherwise.
2.1 The provider and contractual partner for the online courses offered on the platform is the Treeming Organisation, represented by Christian Arzberger, Eugen-Huber-Strasse 12, 8048 ZĂĽrich, Switzerland.
2.2 The subject matter of the contract is the purchase of access to digital content in the form of online courses, which are provided on Treeming.org.
2.3 By purchasing a course, the User agrees to be bound by these terms.
3.1 The presentation of courses on Treeming.org does not constitute a binding offer but is an invitation to place an order.
3.2 By completing the order process, the User submits a binding offer for the purchase of the selected course(s).
3.3 The contract comes into effect when the order is confirmed via email by the Treeming Organisation.
4.1 All prices listed on the platform are final prices and include any applicable taxes.
4.2 Payment methods include credit card, PayPal, and other forms of payment specified during the checkout process.
4.3 Access to the online courses will only be granted once full payment has been received.
5.1 Upon purchasing a course, the User receives a non-exclusive, non-transferable right to access and use the digital content.
5.2 The content may only be used for personal or internal business purposes, depending on the license purchased.
5.3 Sharing, distributing, or publicly reproducing the content is strictly prohibited unless explicitly allowed by the course terms.
6.1 The Treeming Organisation warrants that the digital content will perform as described.
6.2 However, no liability will be accepted for technical issues beyond the control of the platform, including but not limited to internet outages or third-party service provider failures.
6.3 The Treeming Organisation’s liability is limited to damages caused intentionally or by gross negligence. In the case of slight negligence, the Organisation is only liable for breaches of essential contractual obligations (cardinal duties), with the liability limited to foreseeable, contract-typical damages.
7.1 In accordance with international consumer protection laws, digital content is excluded from the right of withdrawal once access has been granted.
7.2 As such, Treeming Organisation does not offer returns or refunds for digital products, including online courses, after the User has gained access to the purchased content.
8.1 Unless otherwise stated, the User is granted indefinite access to the purchased course(s).
8.2 The User does not have the right to terminate the contract after purchase, as access to the digital content is provided immediately following payment.
9.1 The Treeming Organisation collects and processes the User’s personal data only for the purpose of fulfilling the contract and in compliance with relevant data protection laws.
9.2 For further information on how we handle your data, please refer to our privacy policy available on Treeming.org.
10.1 These T&Cs are governed by the laws of Switzerland, without regard to the conflict of laws provisions of international private law.
10.2 If the User is a consumer based outside of Switzerland, mandatory consumer protection laws in the country of residence may also apply.
10.3 In the event of any legal disputes arising from this contractual relationship, the exclusive place of jurisdiction is the registered office of the Treeming Organisation, unless otherwise required by applicable law.
11.1 Should any provision of these T&Cs be deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
11.2 The Treeming Organisation reserves the right to amend these T&Cs at any time. Users will be informed of any changes before they take effect.
